These Terms of Service ("Terms") constitute a legally binding agreement between you ("Student", "Technician", or "User") and Spark Workbase Pty Ltd (ABN/ACN registered in Australia, "Spark Workbase", "we", "us", or "our"). By accessing our website (sparkworkbase.click), registering for educational masterclasses, attending studio workshops in Wagga Wagga, or booking one-on-one technical diagnostics, you agree to be bound by these Terms.
2. Educational Scope & No Financial Advice Disclaimer
Spark Workbase Pty Ltd provides exclusively educational technical analysis training, price action chart interpretation, and candlestick pattern recognition instruction.
Nothing on this website, in our training materials, in live studio demonstrations, or during one-on-one mentoring sessions constitutes financial product advice, investment advice, tax advice, or a recommendation to purchase or sell any specific security, commodity, currency, derivative, or financial instrument under the Australian Corporations Act 2001 (Cth).
You acknowledge that past chart pattern formations do not guarantee future market behavior. Trading and investing in financial markets carries inherent risk of loss. You remain solely responsible for your own financial decisions and capital allocation.
3. Intellectual Property & Course Materials
All curriculum frameworks, pattern classification matrices, annotated chart workbooks, diagnostic templates, video session recordings, and instructional materials produced by Spark Workbase Pty Ltd are the exclusive intellectual property of Oliver Bennett and Spark Workbase Pty Ltd.
Enrollment grants you a non-exclusive, non-transferable, personal license to view and study the materials. You may not reproduce, redistribute, record, publicly broadcast, sublicense, or commercially exploit any course materials without our prior written consent.
4. Enrollment, Fees & Attendance
Tuition fees for masterclasses, weekend workshops, and diagnostic sessions are stated in Australian Dollars (AUD). Enrollment is secured upon receipt of payment or an official deposit invoice confirmation. Attendance at our physical Wagga Wagga facility requires adherence to studio safety guidelines and professional conduct.
5. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, Spark Workbase Pty Ltd, its directors, instructors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your participation in our educational courses or your reliance on technical chart patterns discussed during training.
6. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of New South Wales and the Commonwealth of Australia. Any legal disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
